I will add that, in addition to the legislation that died on the vine, Simon might have been thinking of Rep. Rick Boucher's "FAIR USE Act" (http://www.boucher.house.gov/index.php?option=com_content&task=view&id=1011&Itemid=75) bill, which he has introduced several times in various iterations, as the webpage explains. It's nothing to do with orphaned works, but fair use advocates in Congress are thin on the ground and it's so nice of him to keep trying.
